Welcome to LumaGuide Ltd., a Cyprus company (“the Platform,” “we,” “our,” “us”, "MallorcaGuide.com").

We operate a 100 % online portal for discovering, promoting, and—where applicable—selling tickets for events and activities focused on Mallorca and the rest of Spain. By accessing, browsing or using the Platform as a User (an individual or legal entity that views content or buys tickets) or an Organizer (a creator who publishes, promotes or sells tickets), you agree to be bound by these Terms of Service (“Terms”) and by our Privacy Policy.

If you do not agree to these Terms, you must stop using the Platform immediately.

1. Quick Definitions - Terms and Meanings

  • User - Anyone browsing, registering for or buying tickets
  • Organizer - Anyone creating, publishing or managing events
  • Content - Text, images, audio, video, data or other material uploaded or displayed on the Platform
  • Services - Our discovery tools, guides, promotional features and ticketing services

2. Scope and Acceptance

  • These Terms form a binding contract between you and LumaGuide Ltd., headquartered in Cyprus.
  • You must be at least 16 years old (or the legal age in your country) and legally capable of accepting these Terms.
  • If you act on behalf of a company, you warrant that you have the authority to bind it.

3. Usage Rights

  • For Users
    We grant you a revocable, non-exclusive, non-transferable license to explore guides and events and to register or purchase tickets.
  • For Organizers
    We grant you a revocable, non-exclusive, non-transferable license to:
    a) create brand and event pages;
    b) promote activities;
    c) manage, sell and validate tickets with our tools.

4. Accounts and Security

  • You must provide accurate information and keep your credentials confidential.
  • You are liable for all activity that occurs under your account.
  • We may suspend or delete accounts for breaches, fraud, or security risks.

5. Acceptable Use

You must not:

  • Decompile, reproduce, resell, or sublicense the Platform.
  • Post illegal, defamatory, obscene, violent, discriminatory, or infringing content.
  • Upload viruses, malware, or mass-scrape the Platform without prior written consent.
  • Publish events promoting violence, pornography, or activities not authorized under Spanish law.

6. Publishing and Ticket Sales

You understand and agree that all locations, venues, restaurants, attractions, and events listed in our guides are owned and operated by third parties.

LumaGuide Ltd.:

  • does not own, manage or control these locations;
  • does not inspect or certify their safety, accessibility, food-handling, alcohol-service, crowd-control or any other operational practices;
  • is not responsible for any personal injury, illness, theft, property damage, force-majeure event or other loss that may occur before, during or after your visit.

We are an informational platform; we do not organise events. You participate at your own risk. Before attending, you must independently verify suitability, health-and-safety conditions, availability of medical or emergency services, and any travel advisories.

To the maximum extent allowed by law, LumaGuide Ltd. disclaims all liability for injuries, damages, costs or losses arising out of or in connection with your reliance on the guide or attendance at any third-party venue or event.

7. Payments and Settlements

  • Organizers retain rights to their original content but grant us a worldwide license to host and display it.
  • MallorcaGuide.com service fees are non-refundable unless due to our error.

8. Intellectual Property

  • We retain all intellectual-property rights to the Platform and our trademarks.
  • Organizers retain rights to their original content but grant us a worldwide licence to host and display it.
  • Users and Organizers grant us a perpetual, non-exclusive right to use feedback and suggestions to improve the Services.

9. Data Protection (GDPR)

  • We are the data controller for personal data we collect; Organizers are independent controllers for attendee data they collect.
  • We apply appropriate technical and organizational measures and will notify you of any data breaches without undue delay.
  • You have rights to access, rectify, erase and object to processing of your personal data.

10. Third-Party Links

The Platform may link to external sites that operate under their own terms and policies. We are not responsible for their content or for losses arising from their use.

11. Suspension and Termination

  • You may close your account by emailing support@MallorcaGuide.com.
  • We may suspend or terminate access for material breach, fraud or legal requirement.
  • Upon termination, we will delete or anonymize your data after 30 days, unless a legal obligation requires retention.

12. Indemnity

You agree to protect MallorcaGuide.com from third-party claims that arise from (a) misuse of the Platform, (b) infringing content, or (c) breach of these Terms.

13. Disclaimer of Warranties

The Platform is provided “as is” and “as available.” We do not warrant uninterrupted, error-free or secure service.

14. Limitation of Liability

To the fullest extent permitted by law, our total liability for direct damages is limited to:

  • Users – the service fees you paid us in the 12 months preceding the claim;
  • Organizers – the service or subscription fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.

15. Governing Law and Jurisdiction

These Terms shall be governed by, and construed in accordance with, the laws of the Republic of Cyprus. If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of your country of residence.

In the event of a dispute that cannot be resolved amicably, you may bring proceedings:

  • in the courts of Cyprus (our place of business), or
  • in the courts of your habitual residence, if you live in the European Union.

We both agree to submit to the above jurisdictions and waive any objection based on inconvenience of forum.

16. Amendments

We may update these Terms to reflect legal or functional changes. We will provide 15 calendar days’ notice before the changes take effect. Continued use after that date constitutes acceptance.

  • If any clause is found unenforceable, the remaining provisions remain in force.
  • Failure to enforce a right does not constitute waiver.
  • Headings are for convenience only and do not affect interpretation.
